Inner Wellness Travel
preface

Inner Wellness Travel is a retreat service provider. We can inform, advise and make reservations. Inner Wellness Travel provides these services on your behalf. The booking conditions apply to all services provided by Inner Wellness Travel. The traveler realizes and therefore agrees that Inner Wellness Travel books a trip on his/her behalf. This means that Inner Wellness Travel will agree to the general terms and conditions on behalf of the traveler, even if those conditions have not been handed over to the traveler or otherwise provided.

Inner Wellness Travel is not liable for the correct execution of the services reserved through it. The delivery terms and conditions of the service provider concerned, for example the airline or hotelier, usually apply to this. Inner Wellness Travel is, of course, responsible for the careful execution of the services provided by him, such as correct advice and the correct processing of the reservation.

You are responsible for providing the information necessary to make and execute a correct reservation. This concerns, for example, providing the correct name, address, place of residence, date of birth, nationality, etc. You are also responsible for ensuring that you are in possession of the correct travel documents (passport, visa, vaccination certificates) when you travel. Inner Wellness Travel will be able to provide you with general information after booking.

When you register for a retreat, Inner Wellness Travel will provide you with a confirmation as soon as it knows that there is availability on your selected trip in the desired period. It is up to the traveler to check this confirmation for correctness. We will correct any errors in the confirmation within 2 working days of receipt. Inner Wellness Travel may charge a rate for the provision of its services.

ARTICLE 1 DEFINITIONS
Art. 1.1 The assignment: The assignment entails the agreement between the traveler and Inner Wellness Travel, whereby Inner Wellness Travel undertakes towards the traveler to provide services in the field of travel, in the broadest sense of the word.
Art. 1.2 The travel agent: The person who, in the course of his business, advises, informs and mediates in the conclusion of agreements in the field of travel. Art. 1.3 Service provider: The carrier, accommodation provider, tour organizer and/or other service providers in the field of travel, in the broadest sense of the word, with whom the traveler enters into an agreement and who, subject to the applicable conditions, is responsible for the implementation of the service.
Art. 1.4 Traveller: a. The client (applicant), or b. the person for whose benefit the services provided by Inner Wellness Travel have been stipulated and who has accepted that stipulation.
Art. 1.5 Working days: The days Monday to Friday from 9 a.m. to 5 p.m., with the exception of recognized public holidays, unless the travel agent expressly indicates that other opening hours apply to him.

ARTICLE 2 THE ORDER IN GENERAL
Art. 2.1 The content of the assignment may include informing and advising the traveler, as well as, if possible, reserving the services desired by the traveler for the traveler.
Art. 2.2 The traveler is bound towards Inner Wellness Travel and the service provider after the order has been placed, regardless of whether a confirmation is immediately provided. If a fee is owed for a service of Inner Wellness Travel, Inner Wellness Travel will announce this in advance.
Art. 2.3 The (order) confirmation can be sent to the traveler by email as soon as Inner Wellness Travel knows that there is availability on the trip selected by you in the period you want, in which case this confirmation serves as proof of the confirmation of the agreement. The traveler can then complain within two working days of receipt, failing which the confirmation will serve as proof of the existence and content of the agreement. All this does not affect the possibility for the traveler to provide proof to the contrary.
Art. 2.4 The traveler is fully liable to Inner Wellness Travel as well as to the service provider for the obligations arising from the services provided by Inner Wellness Travel. The other travelers are responsible for their part.
Art. 2.5 No rights can be derived by the traveler from amounts or other information on the website, folder material, the (order) confirmation and other expressions of Inner Wellness Travel. The traveler must check the information provided on the (order) confirmation.
Art 2.6 Inner Wellness Travell reserves the right  to take photos or other

to use visual material for the website, brochure material and social media for the benefit of Inner Wellness Travel.

ARTICLE 3 THE RESERVATION ORDER
Art. 3.1 The traveler will provide Inner Wellness Travel with the information required for concluding the agreement and its implementation regarding himself and the (possible) other traveler(s). When it comes to personal data, Inner Wellness Travel works in accordance with the generally applicable standard in the Netherlands and therefore requires the provision of personal data that may be important for the execution of the trip. This provision does not only concern a mental or physical handicap, but also other qualities that are important for the execution of the trip for the traveler himself or for the group. We reserve the right to refuse the booking of specific persons without stating reasons. Participants in an Inner Wellness Travel holiday must have good health, physical and mental, and condition. If you are not sure whether a trip is suitable for you, please send us an e-mail. If you do not comply with this, you may be excluded from participation and the travel sum will not be refunded. Inner Wellness Travel is at no time responsible for physical condition and ailments.
Art. 3.2 The prices of reserved services can be changed in accordance with the terms and conditions of the service provider. These changes will be communicated and passed on as soon as possible.
Art. 3.3 Possible cancellations of, or changes to, the order(s) provided can only take place on working days and only at the request of the traveler. If, at the request of the traveler, a cancellation or changes are made to reservations already made, the associated costs will be charged. In addition to the cancellation or change costs charged by the service provider, this may also be the costs that Inner Wellness Travel must incur to effect the cancellation or change. Cancellation of the travel agreement by the traveler must be confirmed by telephone  (06-29461715) and by e-mail (info@innerwellnesstravel.com). The date of dispatch is the notification date of the cancellation. Due to the more complex organization that this requires, the traveler owes a contribution if a travel agreement is canceled. When the traveler decides to cancel his trip, the following conditions apply:

*Up to 12 weeks before departure 15% of the travel sum

  • 12  weeks before departure 30% of the travel sum;
  • 11 to 10  weeks  before departure 50% of the travel sum;
  • 9 weeks before departure 75% of the travel sum;
  • From 8 weeks to the day of departure 100% of the travel sum

  • When this retreat cannot take place due to Covid travel restrictions, we will move the retreat to another date. If traveler does not agree to this, he/she will receive the full amount.
  • If a traveler cannot travel to the location due to Covid travel restrictions, the traveler will be refunded the full amount.

Art 3.4 In the event of a flight cancellation of the traveler which is organized by Inner Wellness Travel, within any term, after the confirmation of a trip on our part, we will charge all costs for the flight tickets as required by the travel agent/airline. The traveler can request changes to the travel agreement up to 4 weeks before departure. If the change is not in the nature of a cancellation and if the service providers involved in the travel agree to the request, the change can be made. The change costs amount to EUR 50 (excl. VAT) per booking confirmation per change, plus any additional communication costs. If all or part of the trip is accommodated with a third party, i.e. another Dutch travel organization, foreign travel organization, independent travel organizer or accommodation provider, the amendment conditions of the third party on the relevant trip or part thereof apply in the first place. All communications from Inner Wellness Travel or service provider will be addressed solely to the traveler.

Art 3.5 If, for trips that include transport, the travel and stay duration is stated in the publication in days, the days of departure and arrival, regardless of the departure and arrival time, are counted as whole days. In some cases, this can lead to the actual stay at the destination being fewer days than stated in the publication.
Art 3.6 Many trips on our site are subject to the requirement of a minimum number of participants, below which number the trip cannot be carried out. In case of insufficient participation, the latest date of cancellation by Inner Wellness Travel is 14 days before departure. As a rule, the minimum number of participants is stated with the trip that you book via the site. If the minimum number of participants is not met, we will always try to carry out the trip to avoid disappointment. We will then first consult with you and can usually offer the following options:
• the trip will be carried out anyway, but with a price increase
• an alternative departure date will be offered
• an alternative trip is offered
• a combination of the above options

Art. 3.7 If a travel organizer cancels the travel agreement, for whatever reason, Inner Wellness Travel cannot be held liable for any damage. You are also responsible for taking out a good cancellation insurance for your plane ticket, which also covers the risk if a trip is canceled by a tour operator or hotel owner.

Art. 3.8 Local circumstances and the special destinations that Inner Wellness Travel offers may mean that adjustments must be made to the travel program before or during the trip. Changes in the itinerary due to continued bad weather conditions are also among the possible adjustments. Such changes to the travel program may result in routes, excursions, accommodations and local transport deviating from what is stated in the publication. Inner Wellness Travel and its partners will in that case offer alternatives that maintain the character of the trip as much as possible. The traveler can only reject the change if no reasonable alternative is available and if the change results in a disadvantage of more than minor significance. The aforementioned changes will not affect the travel sum, unless otherwise agreed, nor will the traveler have a claim for compensation against the tour operator on those grounds.

Art 3.9 Having a travel insurance is mandatory. It is recommended to have cancellation insurance. Traveling well insured is an absolute necessity.

ARTICLE 4 PAYMENTS
Art. 4.1 The amounts owed must be paid to Inner Wellness Travel within the period specified in this article (unless otherwise indicated). Inner Wellness Travel is authorized – if necessary in the name and at the expense of the relevant service provider(s) – to collect the amounts owed.

  • For bookings that take place 6 weeks or more before the start of the trip: full amount at once or 50% of the travel sum within 72 hours after booking confirmation. The remaining 85% at the latest 6 weeks* before departure.
  • For bookings that take place within 6 weeks before the start of the trip: 100% of the travel sum within 48 hours after booking confirmation.
    *For some trips, this payment term may be longer. This is then indicated on the invoice

Art. 4.2 The remainder of the amount owed must be received by Inner Wellness Travel no later than the date stated in the confirmation or invoice. The confirmation applies in the event of any discrepancies between confirmation and invoice.

Art. 4.3 If the (down) payment is not made or is not made on time, the traveler is in default and the agreements are deemed to have been cancelled, unless the conditions of the (possibly) involved service provider(s) prescribe otherwise. Inner Wellness Travel then has the right to charge the costs as referred to in Article 3.3 or to settle them with the deposit(s) received.

Art. 4.5 Any refunds are made exclusively to the traveler

promises made by personnel and/or third parties, which deviate in a manifest manner from the conditions stated in these terms and conditions or in the terms and conditions of the responsible service provider, unless such commitments are subsequently confirmed in writing.

ARTICLE 5 LIABILITY
Art. 5.1 Inner Wellness Travel will observe the care of a good contractor in its work.
Art. 5.2 Without prejudice to the foregoing, Inner Wellness Travel accepts no liability for acts and/or omissions of the service provider(s) concerned, nor for the correctness of the information provided by these service provider(s). Inner Wellness Travel bears no responsibility for photos, folders and other information material, insofar as published under the responsibility of third parties.
Art. 5.3 Insofar as Inner Wellness Travel itself falls short and the traveler suffers damage as a result (including damage due to loss of travel enjoyment), Inner Wellness Travel’s liability is limited to a maximum of 25% of the invoiced services.
Art. 5.4 The liability for damage against which the traveler is insured (for example by taking out travel and/or cancellation insurance or health insurance), as well as liability for damage suffered by the traveler in the context of the exercise of a profession or business (including damage due to missing connections or failure to arrive at the destination on time), are excluded.
Art. 5.5 Liability for consequential damage and delay damage is excluded.
Art. 5.6 Inner Wellness Travel is not responsible for any lost items
Art. 5.7 The exclusions and limitations of liability included in this article also apply to the staff of Inner Wellness Travel and/or the third party engaged by them.
Art. 5.8 At your travel destinations (optional) excursions can be offered in which you can participate without obligation. Participation is entirely at your own responsibility and Inner Wellness Travel can never be held liable for any resulting damage, loss and/or injury.

ARTICLE 6 DOCUMENTS
Art. 6.1 The traveler must ensure that upon departure he is in possession of the necessary documents, such as a valid passport and any required visas, proof of vaccinations and vaccinations.
Art. 6.2 At the time of the assignment, Inner Wellness Travel can only provide general information related to the Dutch nationality regarding passports, visas and any health formalities.
Art. 6.3 The traveler will obtain the necessary additional information from the authorities concerned and will also check in on time before departure.

ARTICLE 7 INTEREST AND COLLECTION COSTS
Art. 7.1 The traveler who is in default owes the statutory interest unless the conditions of the relevant service provider prescribe a higher interest rate.
Art. 7.2 The traveler is also obliged to reimburse extrajudicial costs incurred by Inner Wellness Travel to collect the claim, equal to 15% of the claim with a minimum of € 50, unless this amount is unfair taking the collection work into account.

ARTICLE 8 DISPUTES
Art 8.1 All disputes between Inner Wellness Travel – and the Travel Organizers selected by it on the one hand – and the traveler on the other hand are governed by Dutch law. Only a Dutch court is authorized to take cognizance of these disputes.

Art. 8.2 Despite all our efforts and care, it is still possible that you believe you have a justified complaint. If you notice an error or imperfection at the destination, you are expected to report this immediately to the tour guide. If the shortcoming has not been resolved satisfactorily and gives rise to a complaint, you must report this in writing to the tour guide as soon as possible. If the complaint is not resolved satisfactorily, it must be submitted to Inner Wellness Travel no later than one month after returning to the Netherlands. We would like to point out that we cannot handle group complaints.
